Police: Man had sex with passed-out teens

Montana man pleads guilty to felonies

TRAVERSE CITY — A Montana man pleaded guilty to two felony counts after police said he had sex with two female teens after they passed out while drunk and drugged in 2009.

Matthew Charles Hall, 22, pleaded guilty on Aug. 26 to two counts of gross indecency between a male and female. Each felony count is punishable by five years or $2,500.

Hall initially was charged in 2010 with three counts of first-degree criminal sexual conduct. Leelanau County Assistant Prosecutor Doug Donaldson said those charges will be dismissed.

"The new charges are essentially a plea bargain," Donaldson said.

Hall and William Dennis-Mitchell Hamilton, 23, of St. Clair Shores, as well as another man, met two girls in July at the National Cherry Festival and invited them back to Leelanau Pines Campground.

The suspects were in northern Michigan on vacation and are accused of buying alcohol for the teens. A mix of alcohol and other substances the victims voluntarily ingested caused them to become sick and pass out, court records show.

Hall had sex with the victims after they were "essentially unconscious," according to court documents.

Hamilton pleaded guilty in 2010 to attempted tampering with evidence. Authorities said Hamilton deleted his number from one of the victim's cellphones in order to make it more difficult for the teens or police to trace him or Hall to the incident.

Hamilton said he did not have sexual intercourse with the victims and agreed to testify against Hall. Donaldson said new tests found Hamilton's DNA on vaginal swabs of both victims.

"That makes him a liar and a perjurer," Donaldson said.

Donaldson would not comment on whether he is considering new charges against Hamilton, but said, "It doesn't look like the story's over yet."
