New trial in medical marijuana case

TRAVERSE CITY - A state appellate court ordered a new trial for a Kalkaska area man who was convicted of a drug crime but had argued Michigan’s medical marijuana law allowed him to legally grow the substance.

The judge in Archie Kiel’s trial in Kalkaska County Circuit Court erred while giving instructions to jurors, the appeals court ruled. Kiel’s conviction was reversed and he must get a new trial.   

Kiel had been convicted of manufacturing a controlled substance after police raided his home and seized marijuana plants. Kalkaska prosecutors alleged Kiel had grown more marijuana plants than allowed by the state’s medical marijuana law.
